1. Acceptance of Terms

By accessing or using FormDuo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

FormDuo provides a form backend service that allows users to receive form submissions via email. Our Service includes:

Form endpoints for receiving HTML form submissions
Email notifications for form submissions
Submission Control with scheduling and quotas (all plans)
File upload handling and storage (Plus/Pro plans)
Webhook integrations to send data to external services
Customizable Thank You pages (Plus/Pro plans)
Dashboard for managing endpoints and viewing submissions
Visual Form Builder (Pro plan)
CSV export functionality

3. Account Registration

To use our Service, you must:

Create an account with accurate information
Be at least 13 years old
Maintain the security of your account credentials
Promptly notify us of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Send spam or unsolicited messages
Collect personal information without consent
Distribute malware or harmful content
Attempt to gain unauthorized access to our systems
Interfere with the Service's operation
Impersonate others or misrepresent your affiliation
Use the Service for illegal activities

We reserve the right to suspend or terminate accounts that violate these terms.

5. Plans and Pricing

FormDuo offers different subscription plans:

Free: 1 endpoint, 50 submissions/day, 1 webhook per endpoint, Submission Control (scheduling & quotas), no file uploads, default Thank You page with FormDuo branding
Plus ($4.99/month): 5 endpoints, 500 submissions/day, 3 webhooks per endpoint, Submission Control with custom branding, file uploads up to 10MB per file, customizable Thank You pages
Pro ($9.99/month): Unlimited endpoints, unlimited submissions, unlimited webhooks, Submission Control with custom branding, file uploads up to 50MB per file, customizable Thank You pages, Visual Form Builder

Prices are subject to change with notice. Current subscribers will be grandfathered at their existing rate for the duration of their subscription.

6. Payment and Billing

For paid plans:

Payments are processed securely through Stripe
Subscriptions are billed monthly
You can cancel your subscription at any time
Cancellations take effect at the end of the billing period
No refunds for partial months

7. Email Verification

To prevent abuse, all form endpoints require email verification. You must verify that you own or have permission to use the email address associated with each endpoint.

8. Webhooks and Third-Party Integrations

Our Service allows you to configure webhooks to automatically send form submission data to external services. By using webhooks:

You are solely responsible for the webhook URLs you configure
You must ensure the receiving services comply with applicable laws
You are responsible for any data shared with third-party services
We are not liable for the actions or practices of third-party services
Webhook delivery is provided on a best-effort basis

We do not guarantee webhook delivery and are not responsible for failed deliveries due to receiving server issues, network problems, or invalid URLs.

9. File Uploads

Our Service allows Plus and Pro plan users to accept file uploads through their forms. By using file uploads:

You are responsible for the content of files uploaded through your forms
Files are stored securely in Firebase Cloud Storage
File size limits apply based on your subscription plan (10MB for Plus, 50MB for Pro)
Certain file types are blocked for security reasons (executables, scripts, etc.)
Files are automatically deleted when you delete the associated submission
You must ensure you have the right to collect and store uploaded files

We reserve the right to remove files that violate these Terms or applicable laws. Free plan users cannot receive file uploads; submissions containing files will be accepted but file attachments will be skipped.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from individuals whose data is submitted through your forms.

11. Intellectual Property

The Service and its original content, features, and functionality are owned by FormDuo and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit through the Service. By using our Service, you grant us a limited license to process and transmit your data as necessary to provide the Service.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

Perform maintenance with or without notice
Modify or discontinue features
Experience downtime due to factors beyond our control

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMDUO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Indemnification

You agree to indemnify and hold harmless FormDuo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

16. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination:

Your right to use the Service will immediately cease
We may delete your data after a reasonable period
Provisions that should survive termination will remain in effect

17. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
